Eclipse — Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and PugSky Studio ("we", "us", "our") and govern your access to and use of the Eclipse mobile application and any related services (collectively, the "App"). By downloading, accessing, or using the App you agree to these Terms. If you do not agree, do not use the App.

This agreement is between you and PugSky Studio only, and not with Apple Inc. Apple is not responsible for the App or its content. Your use of the App is also subject to Apple's Standard Apple End User License Agreement (EULA).

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, sublicense, or resell any part of the App.

2. Responsible & Lawful Use

You are solely responsible for how you use the App and for any photos or videos you capture with it. You agree to use the App only for lawful purposes and to comply with all applicable laws, including privacy, recording, and consent laws in your jurisdiction. Do not use the App to photograph or record any person in any location or situation where they have a reasonable expectation of privacy, or where their consent is required, without obtaining that consent. We are not responsible for any misuse of the App.

3. Subscriptions (Eclipse PRO)

The App offers optional auto-renewable subscriptions that unlock premium features ("Eclipse PRO"):

Eclipse PRO — Monthly: US$4.99 per month
Eclipse PRO — Yearly: US$29.99 per year

Prices are shown in the App before purchase and may vary by region and over time. Local taxes may apply.
Payment is charged to your Apple ID account upon confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
You can manage or cancel your subscription at any time in your Apple ID Account Settings after purchase. Cancellation takes effect at the end of the current billing period; the current period is not refundable except where required by law.
If a free trial is offered, any unused portion is forfeited when you purchase the corresponding subscription.

4. Free Features & Ads

Some features are available without a subscription and may be supported by advertising or limited by usage caps. Subscribing to Eclipse PRO removes ads and unlocks the premium features described in the App.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect and how it is used. Photos and videos you capture in the App's private vault are stored on your device unless you choose to save them elsewhere.

6. Intellectual Property

The App, including its design, text, graphics, and software, is owned by PugSky Studio and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, PugSky Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) the App. Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
